Nintendo is currently facing a class-action lawsuit as it seeks to dismiss claims that it should share U.S. government tariff refunds with its customers.

Supreme Court ruled in February 2026 that certain tariffs were unlawful, prompting Nintendo to recover the fees it had paid to the government.

Shortly after, consumers sued Nintendo, arguing that because the company raised product prices in 2025 to offset those tariffs, keeping the government refund constitutes 'double-dipping.'

Nintendo is pushing for the case's dismissal, asserting that the initial purchases were valid commercial agreements where consumers agreed to pay the set price.

They argue that customers have no legal right to a rebate and that the price hikes were influenced by broader market conditions rather than solely tariff costs.
